General Terms and Conditions of Ritchey International On-Line Shop - valid from 1st of January 2008 § 1 Scope Only the following General Terms and Conditions as amended at the time of the purchase order apply to the business relation between Ritchey International Sagl, Via Cantonale 2, 6916 Grancia, Switzerland and Buyer. Ritchey International Sagl (hereinafter referred to as Ritchey) will not accept any deviation to conditions of Buyer unless Ritchey has expressly agreed in writing. § 2 Partners to the contract Ritchey International On-Line Shop is operated by Ritchey International Sagl, Via Cantonale 2, 6916 Grancia, Switzerland. If a contract is concluded (see § 3), Ritchey International Sagl shall be the Buyer's partner to the contract. Through the Ritchey International On-Line Shop Ritchey International Sagl will only sell to final consumers, not to dealers, wholesalers or any other kind of commercial company. § 3 Conclusion of the contract After placing an order with Ritchey International Web Store, you will receive an order confirmation via e-mail if you have provided an e-mail address. This confirmation acts as confirmation of receipt and does not constitute a legally binding acceptance of your order. The contract is concluded between you and Ritchey when your order is accepted by shipping the goods. All goods remain property of Ritchey until paid for in full. Our prices naturally include value-added tax at the statutory rate. Due to permanent improvements in product quality, the actual product may occasionally differ from that illustrated and / or specified. All stated performances, dimensions, weights and sizes are approximate. We cannot accept any liability for errors (which hopefully will not occur), unless they are caused by gross negligence or intent Ritchey. Instructions on cancellation – return policy § 4 Instruction on Buyer's right to cancel Buyer is entitled to cancel his offer to conclude a contract within 10 working days upon having received the shipment, with no necessity to state reasons. Buyer must make a written notification to the premises of Ritchey, or by returning the product via registered shipment within 10 working days upon having received the shipment. This 10 day period starts on receipt of these instructions at the earliest. The timely return of the goods by registered shipment or through written notification respectively will complete buyer’s requirement to exercise the period of cancellation. This e-mail address is being protected from spam bots, you need JavaScript enabled to view it Fax: + 41 91 960 5221 No such right to cancel exists for buyers that are entrepreneurs (i.e. companies, distributors, retailers) and thus act in the performance of their business as a reseller or freelance activity. § 5 Instruction on the consequences of cancellation In case of a valid cancellation, the goods have to be returned to Ritchey. The transit costs for returning goods shall be paid by Buyer. If Buyer is not able to return the goods in original condition with original packaging, Buyer forfeits all rights to return goods. This shall not apply if the goods are defective. Determination of defective goods is exclusively based on a reasonable standard that a retail shop would apply. Moreover, Buyer may prevent his obligation to compensate Ritchey for the value of the goods if they are used or installed on the bike. In the event of an on-time order cancellation, Ritchey shall reimburse the purchase price already paid, minus the original and return shipping charges, within 30 days after the goods are received at Ritchey. If not otherwise agreed, the delivery will be made to the delivery address indicated by Buyer. Any statements about the term of delivery are unbinding unless the date of delivery is stated bindingly in exceptional cases.
Shipments are made through Swiss Post International, who may rely on other partners outside Switzerland. Shipping charges are calculated according to total weight of the package at the check-out. You can choose between Economy or Priority shipping. If the product is in stock your shipment will take 2/3 days to process, upon receipt of payment. Should the product be backordered, you will be promptly notified by e-mai, you will have a choice to leave the order active until the product is ready to ship. Economy shipping takes about 6-10 days for Europe and 9-25 days worldwide; Priority shipping takes about 3-6 days for Europe and 4-9 days worldwide. All shipments are insured for the value of the goods in the shipment. All shipments will be made using the Green Custom Declaration, with boxes weighing less than 2.00 ks and within the admitted sizes and volume. If a shipment will be stopped by the Custom Office of the final destination, the buyer may be asked to pay importation duties and custom clearance costs. In general delivery time frames are respected. Unfortunately in some countries the local custom and/or postal service are quite inefficient and might cause some delays. § 7 Exchange Ritchey is not obligated to exchange faultless goods. Ritchey will normally comply with the request of Buyer to exchange, as far as it is possible. Ritchey shall be entitled to claim additional shipping cost for the 2nd shipment. The right of Buyer to cancel (compare §4 and §5) is not limited or excluded in any way by this provision. § 8 Payment Buyers can pay Ritchey International Web Store by credit card (Mastercard and Visa), and SwissPost Card. Simply state your preferred method of payment when ordering. § 14 Data protection and data security Your personal data, such as credit card number, postal code, bank account number, name, and address entered in the scope of the purchase order will be encoded and therefore secured against unauthorized access on the Internet. Ritchey uses a safe transfer process, the so-called "Secure Socket Layer" (SSL) transfer to process customer data. The handling of personal data (names, postal addresses, telephone and / or credit card numbers) which the customer discloses to Ritchey in the line of order fulfilment is liable to data protection laws. When placing an order, the customer agrees that his personal data is being stored in a machine-readable way and can be processed for order fulfilment. The transmission of this personal data to a third party without consent of the customer is not permitted. The customer explicitly agrees to the transmission of data to a third party in the line of order fulfilment only, particularly for the performance of credit checks. § 15 Applicable law The contract between Buyer and Ritchey is made under Swiss law, and in case of controversy Swiss laws are applicable. Any dispute, controversy or claim arising out of or relating to the contract shall be brought before the legal courts in Lugano. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
